These Terms of Use govern your access to and use of the Education Intelligence Asia website, newsletters and related content operated by Business Intelligence Asia ("BIA", "we", "us" or "our"). By accessing or using the website, you agree to these Terms. If you do not agree, please do not use the website.

1. Information service

Education Intelligence Asia provides news, analysis, commentary and other information concerning the sectors covered by Education Intelligence Asia. Content is provided for general information only. It is not legal, financial, investment, engineering, safety, procurement or other professional advice and should not be relied upon as a substitute for advice from a suitably qualified professional.

You are responsible for evaluating information and making your own decisions. You should independently verify information before acting on it.

2. Accuracy and availability

We aim to provide useful and timely information, but we do not guarantee that content is complete, accurate, current or suitable for a particular purpose. Projects, regulations, prices, appointments, transactions and other matters may change after publication.

We may correct, update, withdraw or restrict content at any time. We do not guarantee uninterrupted, secure or error-free access to the website or newsletters.

3. Intellectual property

Unless otherwise stated, the website and its original text, graphics, branding, layout and other content are owned by or licensed to Business Intelligence Asia and are protected by applicable intellectual-property laws.

You may view the website and print or save reasonable extracts for your own internal, non-commercial use. You must not, without prior written permission:

  • reproduce, republish, distribute, sell or commercially exploit substantial content
  • systematically scrape, harvest, index or create a database from the website
  • remove copyright, attribution or proprietary notices
  • present our content in a misleading context or imply our endorsement; or
  • use our branding, logos or trade names.

Brief quotations for reporting, commentary or citation are permitted where allowed by law and where clear attribution and a link to the original page are provided.

4. Acceptable use

You must not:

  • use the website unlawfully or to infringe another person's rights
  • attempt to gain unauthorised access to the website, accounts, servers or data
  • introduce malware or interfere with website operation or security
  • conduct automated extraction or high-volume requests that burden the service
  • impersonate another person or misrepresent your affiliation; or
  • use contact details obtained from the website for unsolicited marketing or abuse.

5. Newsletter subscriptions

You may subscribe using an email address you are authorised to use. You may unsubscribe at any time using the link provided in an email. Delivery is not guaranteed and may be affected by email providers, filters, technical issues or service limits.

The website may quote, summarise or link to third-party sources. Links are provided for information and convenience and do not imply endorsement. We do not control third-party websites and are not responsible for their availability, accuracy, security, products, services or privacy practices.

If you send us comments, corrections, tips or other material, you confirm that you are entitled to provide it and that it is not unlawful, defamatory, confidential in breach of an obligation, or infringing. You retain ownership of your material but grant us a non-exclusive, worldwide, royalty-free licence to review, edit, reproduce and publish it for editorial and operational purposes, unless we agree otherwise in writing.

We are not obliged to publish, retain or respond to submitted material.

To the fullest extent permitted by law, the website, newsletters and content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

To the fullest extent permitted by law, Business Intelligence Asia and its personnel will not be liable for indirect, incidental, special or consequential loss, loss of profit, revenue, business, opportunity, data or goodwill arising from or connected with use of, or inability to use, the website or reliance on its content.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

9. Suspension and termination

We may suspend or terminate access to all or part of the website where reasonably necessary for security, maintenance, legal compliance, protection of rights or misuse of the service.

10. Changes to these Terms

We may update these Terms from time to time. The effective date at the top indicates the latest revision. Continued use of the website after revised Terms are published constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of Malaysia. Subject to any mandatory rights that apply, the courts of Malaysia will have jurisdiction over disputes arising from or connected with these Terms or the website.

12. General

If any provision is found invalid or unenforceable, the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and any expressly stated additional terms, constitute the agreement relating to use of the website.
